ALLEYS, HIGHWAYS, BRIDGES AND OTHER PUBLIC PLACES IN THE TOWN OF SUPERIOR, PINAL COUNTY, ARIZONA, WATER LINES, PLANT AND SYSTEM, INCLUDING MAINS, LATERALS, PUMPS, MANHOLES, METERS, FIRE HYDRANTS, REGULATOR STATIONS AND RELATED EQUIPMENT, FACILITIES AND APPURTENANCES, FOR THE PURPOSE OF SUPPLYING WATER TO THE TOWN OF SUPERIOR, ITS SUCCESSORS, THE INHABITANTS THEREOF, AN]) ALL PERSONS AND CORPORATIONS EITHER WITHIN OR BEYOND THE LIMITS THEREOF; PRESCRIBING CERTAIN RIGHTS, DUTIES, TERMS AND CONDITIONS IN RESPECT THEREOF; AND REPEALING CONFLICTING RESOLUTIONS. BE IT ORDAINED by the Mayor and Common Council of the Town of Superior, Pinal County, Arizona, as follows: SECTION 1. There is hereby granted to Anzona Water Company, a corporation organized and existing under and by virtue of the laws of the State of Arizona, its successors and assigns (herein celled "Grantee"), the renewal of the right, pdvUege and franchise to construct, maintain and operate. upon, over, along, across and. under the present and future streets, avenue, alleys, highways, bddges and other public places in the Town of Superior, Arizona (herein called "Municipality"), water lines, plant and system, including mains, laterals, pumps, manholes, meters, regulator stations and related equipment, facilities and appurtenances, for the purpose of Supplying water to the Municipality, its successors, the inhabitants thereof, and all persons and corporations either within or beyond the limits thereof. SECTION 2. All facilities to be constructed under this grant shall be constructed and maintained in accordance with established practices with respect to such streets, avenues, alleys, highways, and bridges arid public places of the Municipality. Prior to such construction, a map showing the location of such facilities shaM be submitted to such persons as may be designated by the Common Council of the Municipality. SECTION 3. In the event that any lines or related facilities installed or constructed under' this grant shall at any time be found to interfere unduly with vehicular and pedestdan traffic over such streets, avenues, alleys, highways or bddges, the Grantee hereby agrees that it will, at its own expense, and within a reasonable time after notice thereof by the Municipality, remove or relocate said lines, or related facUitlas so as to minimize said interference. In all other instances, the costs incurred in relocating any lines or facilities shall be borne by and added to the cost of the pub c or pr vate mprovement causing or resulting in such relocation. SECTION 4. In case of any disturbance of pavement, sidewalk, ddveway or other surfacing, planting or ground cover resulting from Grantee's action, Grantee shall at its own cost and expense and in a manner entirely satisfactory to the Municipality and the department having appropdate judsdiction, replace and restor e all paving, sidewalk, driveway, surfacing, planting or ground cover of any street, alley or other public way or place in as good condition as it was pdor to said disturbance. All work shall be completed with due diligence. Further, to avoid duplication of effort and untimely destruction of the street, the Grantee shall coordinate its construction and replacement plans with the Municipality Street Department. SECTION 5. Grantee shall save the Municipality harmless from any expenses and losses occasioned by reason of the exercise of this franchise by Grantee. SECTION 6= As a further consideration for the franchise hereby granted, Grantee will pay to the Municipality a sum equal to 2 % of the gross receipts of the Grantee from the sale of water at retail for residential and commerca purposes within the corporate limits of the Municipality, as shown by Grantee's billing records, such paymentsto be due and payable within thirty (30) days after the end of each quarterly period. For the purpose of verifying the amounts payable hereunder, the books and records of Grantee shall be Subject to inspection by duly authorized officials or representatives of the Municipality, at reasonable times. Said payment shall be a franchise tax and shall not be taken or considered to be in lieu of any tax or taxes, license fees, charges or assessments of the Municipality now existing or hereafter levied upon the business or property of Grantee, or its successors, provided that Grantee may deduct any tax, license fees. charges or assessments or other exaction paid by it, which is assessed or levied by=the Municipality exclusively upon public utilities up to the amount payable under the terms of this section; provided further that the amount of such franchise tax may be lawfully and specifically added to customers' bills. SECTION 7. The nght, privilege, and franchise hereby granted'shall continue and exist for a pedod of twenty-five (25) years from the effective date hereof, and upon approval by a vote of the qualified electors of the Mualoipality and acceptance by the Grantee. this franchise shall be deemed effective as of the date of approval of this Ordinance and the passage of the Resolution referring this Ordinance and Franchise to the qualified electors of the Municipality. SECTION 8. The right, privilege and franchise hereby granted may be transferred in whole or in pare ny the Grantee. its successors and assigns, upon approval of the Arizona Corporation Commission or its successors, provided that in the event there is no such regulatory agency then having .urisdictlan. such transfer shall not be made unless a resolution consenting thereto has been adopted by the Mayor and Common Council of the Municipality; provided however, that the foregoing shall not be deemed to require consent in the case of an assignment made as security pursuant to a mortgage and deed of trust. or any transfer made in enforcement of dghts thereunder or by action of law or in the case of a transfer pursuant to a merger or consolidation with or into another corporation which assumes the obligation of the Grantee hereunder. SECTION 9. This grant is not exclusive, and nothing herein contained shall be construed to prevent the MunicipaUty from granting other like or similar grams or pnvileges to any other person, firm or corporation, or to deny to or lessen the powers and privileges granted the Municipality by Article 2 of Chapter 5. of Title 9. Arizona Revised Statutes. SECTION 10. All ordinances and parts of ordinances in conflict with the provisions hereof are hereby repealed to the extent applicable to a franchised oubUc service corporation. SECTION 11. If any section, paragraph, subdivision, clause, phrase, or provision of this Ordinance shall be adjudged inyalid or unconstitutiona, the same shall not affect the vafidity of this Ordinance as a whole or any part of the provisions hereof other than the Dart so adjudged to be invalid and unconstitutional SECTION 12. The Municipality reserves the right and Dower to purchase or condemn the plant and distribution facilities of the Grantee within its corporate limits or any addition thereto as provided by law. SECTION 13. Uoon the expiration of;anchise, if the Grantee shall not have acquired an extension or renewal thereof and accepted the same. t may remove its facilities and system within the Municipality or at its option may continue operating ts facilities and system within the Municipality until a new franchise can be affected with the Municipality. SECTION 14. To preserve the public peace, health, and safety, it is necessary that this Ordinance become immediately operative. It is therefore declared to be an emergency measure to take effect upon its enactment by the Mayor and Common Council of the Municipality following its submission to the electors and upon compliance with reeulrements as to the publication or posting. I I i 866-385-7068 I INSTALLED FREE IN UP TO 4 ROOMS I Public 'Notice U.S. Department of Agriculture, Forest Service Tonto National Forest, Globe Ranger District Announces Public Comment Period on the Environmental Assessment for the Resolution Pre-Feasibility Activitiee Plan of Operations Public Comment Period: April 1, 2009 through April 30, 2009 The Tonto National Forest is seeking comments on the Environmental Assessment (EA) prepared in response to Resolution Copper Mining's (RCM) submittal of a plan of operations for prefeasibility activities to support their ongoing pre-feasibility studies of Resolution Copper Mining project, The proposed action for the Pre-feasibility Plan of Operation activities includes: 1 ) Constructing five exploration drill sites impacting approximately 1.14 acres and directional drilling operations on those sites; 2) Constructing eight dHU sites to accommodate a total of three deep and six shallow groundwater testing and monitoring wells impactidg approximately 1.78 acres: 3) Constructing nine drill sites impacting approximately 1.8 acres to accommodate a total of nine geotecnnlcel characterization boreholes: 4) Continuing excloratory an(: monitoring activities at previously authodzeo driU sites that had impacted approximately 3.02 acres: 5) Completing necessary roadway improvements on approximately 16.97 miles of existing roads impacting approximately 33.39 acres: 6" Construction of 0.33 mile of new roads impacting 0.55 acres: and. 7) Ongoing road maintenance to maintain access to drill sites The new construction activities DrODOSeO would occur on 38.66 acres and the previously authorized activities have impacted 3.02. The total area affected would be 41.68 acres of National Forest System lands Alternatives to the proposed action that were evaluated in the EA include: 11 No Action: 2) One alternative location for an axploretion drill site to avoid impacts to the "Campground Boulder," a popular recreation and climbing area. 3) Two alternative access routes for drill site locations developed i response to nubile scoping comments that suggested an alternative route be built to avoid traffic concerns in the area. The EA discloses the direct, indirect and cumulative environmental impacts that would result from the proposed Pre-feasibility Activities and alternatives developed in response to specific scoping comments and engoing evaluation of the RCM proposal. The Forest Supervisor is the deciding officer with regard to the Pre-feasibility Plan of Operations. Based on the analysis in this EA, the Forest Supervisor would frst determine if an Environmental Impact Statement (EIS) is required. If an EIS is not reauired, the Forest Supervisor's final decision notice would be a finding of no significant impact IFONSI). The Forest Supervisor wilt also determine if approval of the Pro-feasibility Plan of Oeeratien would be consistent with the Forest Plan. or if an amendment to the Forest Plan is required.
